Question:
H1B: 4th year running
GC process: 140 filed, waiting for priority date to become current and then apply for I-485
Priority date is Oct 2007, so not expected to be current this year.
Can I apply for F1 starting next year? This is for an MBA course.
What are the risks involved?

Yours will be EB1C. You can expect to get GC in 1-2 years.
If i-140 premium processing comes back, then typically within an year. (know of 2 people who got done within 8 months... EB1-India). Right now the I-140 is going to take the longest time..

Hi guys,
My I140 was approved last week (RD July 2007). I have the approval notice copy from the lawyer but the online status is still saying its pending.
I called uscis and she told me that she is seeing that its pending too but if i have the approval notice then not to worry. It takes them some time sometimes to update the system, as per her.
But my concern is, when my PD becomes current and if their own system shows my I140 penidng(eventhough it's approved), how will they approve 485?
Any one in same boat or any past experience?

now-a-days, Online system is not in sync with the case system. Level CSR will see what you see on online system. As long as you have the hardcopy of the approval, you are good to go. Someday, online status will change.

What docs are required for re-entry of spouse on H4 visa. The primary applicant on H1 is not travelling.
1. Copy of I-797 of H1 visa holder.
2. Passport copy of H1 visa holder.
3. Recent pay stubs of H1 visa holder.
3. Marriage Certificate.
Am I missing something.

Not sure you need any of 2, 3 or 4. However, it is very helpful to have a letter from the H1 employer saying that you are still employed by your company or whatever you work for and your spouse is currently on an H4 dependents visa.
My husband has found this has been adequate on many occasions.

President Obama will send up to 1,200 National Guard troops to the Southwest border and increase spending on law enforcement, yielding to demands from both Republican and Democratic lawmakers there that border security be tightened, administration officials said.

The troops have not been involved directly in intercepting border crossers.
In addition to the soldiers, the White House said it would request $500 million in supplemental funds to pay for more federal agents, prosecutors, investigators and technology at the border.

My father passed away recently and my mother wishes to travel with my wife and I on a visitor visa.
How can she apply for 10 year multiple entry visa? Can she return after the visa expires, after a month? Any experiences anyone can share? Are there any reasons why some visas get denied?
My wife and I are permanent residents and we want to know whether this is of any advantage/disadvantage.
Any pointers/info/help are much appreciated. I looked through the relevant IV threads and yes, they are informative but rules change all the time and I decided to just go ahead and post this thread to get the latest feedback.
Has your mother gotten US visitor visa before? The most important point is to prove to the consulate that your mom will return back from USA. To prove that you need to show some strong ties in your home country. Now that she is a widow it can work against her unless your siblings are still in india. All other things are secondary.
The number of years for the visa can range from 3 months to 10 years and it depends on how strong your mother's case is.

A brief background: I have approved labor (PD Jun04/EB3), I-140 rejected & pending I-140 (MTR filled in Jan'07) with attorney A. Meanwhile got PERM LC approved & filled I-140 & I-485concurrently in Aug.07 thru Attorney B (recipt recived).(FYI....the same company did Old & New PERM Labor)
Now the question is, If my old I-140 gets approved, than do I have any benefit/advantage using that Old approved I-140 PD of Jun04 when my new I-140 gets approved? In short, can I still use my OLD priority date? (Jun04).(even though I have already concurrently filled New I-140 & I-485 in aug.07).
Any thoughts/suggestions/advice/ideas are appreciated. thanks.

Occupation Title: Computer Software Enginner
OES Code: 15-1031
New Position: Sales Consultant
For the Sales consultant position the description is much more technical and macthes 50% with whats Computer Software Enginner.
1. What are the immigration steps that need to be considered for the portability(AC21) ?
2. If new corporation says we cannot do the portability because of say OES code or something else what are the options to still take the job ?
Let me know !!

But this time there are 90+ dems and Reps co-sponsored this bill..so chance of this getting passed is enormous and I was hoping since this is the child of those claiming to be the champions of the legal immigration ..could probably insert something to bring relief to the legal community..
