YES! EAD is your license to work for any company, even for those not sponsoring you. It doesn't matter if your i140 is approved or not, you can work with EAD and that is legal.

My first LC did not get approved or denied. So i did not applied I-140. I guess my only option to wait and to see what the brain dead congress action is.

this makes it very hard for people who jumped jobs in their 7th/8th years with 1 year extensions from new employer. All were hoping to get LC+I_140 done within that year so they are eligible for further H1B extensions.

I too had the paralegal filled out wrong information in regard to my employment history. My lawyer said the same thing; once it is on ETA 9089, you could not really change anything.
In fact, you could not change it when you file I-140. The only thing you could do is to discuss with your lawyer about possible RFEs.
Last but not least, don't sweat it. Worrying won't change anything.
And as for my case, it was approved without any RFE request.

EB2, officially known as "members of a profession holding advanced degree", requires a "Masters degree". USCIS views a BS+5 as equivalent to a masters degree for this purpose.

Non-profit organizations...as the name emplies are organizations that doesnt aim to make a profit...and if they ever do, it must be retained within the organization so they can support their own programs and services. Examples are foundations, charities--they are tax favored. I know some schools are too---and hospitals. Ive worked in one hospital before. You can find it out by reading what a company is all about...visions, missions...they will usually say they are not for profit organizations if ever they are...hope this helps....by the way...they are VISA CAP EXEMPT!

Every time I call USCIS to inquire if my I-140 is filled under EB2 or EB3. They ask me to ask my lawyer or employer to call. They won't tell me. I do have a copy of I-140 that states it is Eb2 (Advance degree and all) but I am concerned about what is there in USCIS system.
I cannot ask my previous enployer to call as I have left the company using AC21.
Please advise what is the solution?

harry the reason u may not be getting much of a response to your thread might be because the AC21 portability issues have been discussed in detail several hundred times on this forum.
