SO I have a question. I received my 45 day letter way back in Jan 2006. As of today, no action has been taken on my application. I have recentlly acquired the help of my congressmen to find out what the hold up is. I am waiting since Oct 2001.
I have done a PERM and it has been approved, my I140 has been approved and now waiting for dates to become available. Here is my status as of yet.
I am in my 8th year of h1. I will be applying for extention of my 9th year within a couple of months. I will use my I140 to get 3 years extension. SUppose my old labor is up, can I use my Perm advertisement for that. The job oppourtunity was same for PERM as it is for old labor. Will it be different advertisemtn. Those who have go that labors approved, what kind of advertisement does the DOL requires when its NON RIR. How long does that usually take.
My company might be getting sold in the near future. So there is a possibility that I will loose my job. what are my options then. I only have 5 monts left on my 8th year H1b visa. Suppoe my extension is approved for 3 years base of my I140, before the company is sold. Can I transfer my H1b visa toanother compnay. what if it is in a different state.
Can congressional inquiry help the process speed up a little bit.
Anyone who has gone through this, your response will be appreciated.

This is true even if the couple is legally married in their home country. Often, the "dependent" partner must apply for a B-2 visitor visa at the consulate, to accompany his/her partner. This visa is discretionary, and consulates could refuse to issue it. In addition, B-2 status does not allow the dependent partner to work in the US. Many heterosexual dependent spouses have a status that doesn't allow them to work either, however.

I have my I-140 approved. My wife is filling I-539 form for extension of stay. I just want to make sure from you guys, in the form where it says 'Are you an applicant of an immigrant visa' she has to say 'No'. As I am guessing until I-485 is filed, our answer to this question is always 'No'.

It's really unfortunate, but what's in that cartoon is the truth. The humor is for people who don't have to go through that flow-chart or the people who get out quick.
for people who are in that loop for 13 years, it's the tragedy of life.

We got our EAD cards today.
We had gone for FP on Sept 19th and saw LUDs on Sep 20th on our I-485s. But the EAD cards came without our fingerprints. EAD cards came from the same Service center (Nebraska) where the FP notices came from. So wondering, how they did not include our fingerprints in the EAD card?? I had also checked with FBI helpline two weeks back and verified that the FPs were delivered to USCIS.
Anybody else in similar situation?

Hi,
Recently, I have used AP for my travel from IAD. I was sponsored by company A and I am working for company B on EAD. At POE the CBP officer asked me if I am still working for Company who sponsored my GC. I said no. I told them I work for Company B. They just listened and let me in.
The other question that they asked me how long was my stay outside US. I was not sure why they asked that question.

My company is using substituted labor for me and applying for 140 and 485. My original LC which was pending just got approved. But the physical documentation is not there.
But my company is saying that they will also apply for 140 for the original LC also. How is this possible? I'm confused. What will happen to the 485 (and the first 140) when they file second 140?

Please be careful. some days back some of my friends caught up with this substitute LC and lost money. Please be careful before investing any kind of money esp if it is for desi body shoppers. USCIS is taking strict major and many substitute LC are getting rejected. so be cautious

I had this experience in the past...when my H1 Extension is applied sometime back, they gave me a new i-94 number (probably due to an error)....however, when I left the country for a vacation, I stapled & returned both I-94's as per my attorney's suggestion (through my emp)...

Under certain circumstances, your International Student Advisor can grant a leave of absence for one semester for you. You need to get some paperwork from a doctor which will state that you can't attend college and why and for what reasons. However, this is not an easy case. Secondly, once you husband applies for I-130 based on marriage, this may violate your F-1 status as F-1 has purely non-immigrant intent and by filing I130 you show you intend to immigrate to the U.S.
I tried to help my friend to transfer to another school when he was on F-1. A month after he transferred to the new school, the IS Advisor told him that his F-1 status has been canceled in the SEVIS system. Later, through FOIA he learned it was due to I-130 petition filed by his wife on his behalf a few months earlier. Conicidently, they canceled his F-1 just after the I130 approval. Luckily, his wife became a US citizen just few months later and he adjusted status due to that.
I always advise to speak to an immigration attorney before taking any action. Thank you.

A federal judge in Phoenix on Wednesday blocked key provisions of Arizona's controversial immigration law from taking effect as scheduled Thursday, granting in part an injunction requested by the Obama administration.
U.S. District Judge Susan Bolton ruled that the injunction would apply to the portion of the state law that requires police to try to determine the immigration status of a person they arrest, stop or detain while enforcing other laws if they reasonably suspect the person is in the United States illegally.
In a lawsuit filed against Arizona, the Obama administration said the law was unconstitutional and warned that the provision would result in racial profiling and harassment of U.S. citizens, legal immigrants and foreign visitors.
Bolton said in her ruling that it was "not in the public interest" for Arizona to enforce a provision that preempts federal enforcement of immigration law.

We all have only 1 thing going on in our mind where every we go & what ever we do is about GC when it will arive. You see this offer & that offer. What you do ? nothing. Because you dont have EAD or GC
So now is the time we all can get together start our effort. No one knows about the result. Atleast some day some one will hear our voice.
This is my first visit to this web site. I have contributed $100 dollars.
Please give help to achive this target. wether it is $1,5,10,20,100,200 etc.
